Supreme Court Extends Mandatory Third-Party Insurance Period for New Vehicles

The Supreme Court of India has directed that all new private cars must now be sold with four years of mandatory third-party insurance, while new two-wheelers must carry six years of third-party cover. The decision extends the earlier mandatory insurance period by one year and aims to improve compliance with the Motor Vehicles Act while enhancing protection for road accident victims.

The judgment was delivered by a Bench comprising Justice Sanjay Karol and Justice Prashant Kumar Mishra while disposing of an appeal filed by National Insurance Company Ltd. During the proceedings, the Court noted that despite its 2018 directions requiring three-year third-party insurance for new cars and five-year cover for new two-wheelers, a significant number of vehicles continue to operate on Indian roads without valid insurance.

To address this issue, the Court directed the Insurance Regulatory and Development Authority of India (IRDAI) to issue the necessary instructions for implementing the revised insurance period. The objective is to ensure that more vehicles remain insured for a longer duration, providing better financial protection to victims of road accidents and strengthening compliance with mandatory insurance requirements.

Apart from extending the insurance period, the Supreme Court also called for a more transparent and consumer-friendly motor insurance framework. It emphasised better enforcement of compulsory insurance provisions and suggested greater use of technology to identify uninsured vehicles. Reports also indicate that the Court has proposed exploring a pilot project that could link fuel purchases with valid third-party insurance to improve compliance.

The ruling applies to newly purchased vehicles and concerns mandatory third-party insurance, which covers legal liability for injury, death or property damage caused to third parties. It does not automatically extend the own-damage component of a comprehensive motor insurance policy, which continues to follow the applicable policy terms offered by insurers.

ಹೊಸ ವಾಹನಗಳಿಗೆ ಕಡ್ಡಾಯ ತೃತೀಯ ಪಕ್ಷ ವಿಮೆ ಅವಧಿ ವಿಸ್ತರಿಸಿದ ಸುಪ್ರೀಂ ಕೋರ್ಟ್

ಭಾರತದ ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಹೊಸ ಖಾಸಗಿ ಕಾರುಗಳಿಗೆ 4 ವರ್ಷಗಳ ಕಡ್ಡಾಯ ತೃತೀಯ ಪಕ್ಷ (Third-Party) ವಿಮೆ ಹಾಗೂ ಹೊಸ ದ್ವಿಚಕ್ರ ವಾಹನಗಳಿಗೆ 6 ವರ್ಷಗಳ ಕಡ್ಡಾಯ ತೃತೀಯ ಪಕ್ಷ ವಿಮೆ ಇರಬೇಕೆಂದು ಆದೇಶಿಸಿದೆ. ಈ ತೀರ್ಪಿನ ಮೂಲಕ ಹಿಂದಿನ ಕಡ್ಡಾಯ ವಿಮೆ ಅವಧಿಯನ್ನು ಒಂದು ವರ್ಷ ಹೆಚ್ಚಿಸಲಾಗಿದ್ದು, ರಸ್ತೆ ಅಪಘಾತ ಸಂತ್ರಸ್ತರಿಗೆ ಹೆಚ್ಚಿನ ಆರ್ಥಿಕ ಭದ್ರತೆ ಒದಗಿಸುವುದು ಹಾಗೂ ಮೋಟಾರು ವಾಹನ ಕಾಯ್ದೆಯ ಅನುಸರಣೆ ಹೆಚ್ಚಿಸುವುದು ಇದರ ಉದ್ದೇಶವಾಗಿದೆ.

ಈ ತೀರ್ಪನ್ನು ನ್ಯಾಯಮೂರ್ತಿಗಳಾದ ಸಂಜಯ್ ಕರೋಲ್ ಮತ್ತು ಪ್ರಶಾಂತ್ ಕುಮಾರ್ ಮಿಶ್ರಾ ಅವರ ಪೀಠ ನೀಡಿದೆ. 2018ರಲ್ಲಿ ಹೊಸ ಕಾರುಗಳಿಗೆ 3 ವರ್ಷ ಹಾಗೂ ಹೊಸ ದ್ವಿಚಕ್ರ ವಾಹನಗಳಿಗೆ 5 ವರ್ಷಗಳ ಕಡ್ಡಾಯ ತೃತೀಯ ಪಕ್ಷ ವಿಮೆ ಇರಬೇಕೆಂದು ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ನೀಡಿದ್ದ ನಿರ್ದೇಶನಗಳಿದ್ದರೂ, ದೇಶದಲ್ಲಿ ಇನ್ನೂ ಅನೇಕ ವಾಹನಗಳು ಮಾನ್ಯ ವಿಮೆಯಿಲ್ಲದೆ ಸಂಚರಿಸುತ್ತಿವೆ ಎಂದು ನ್ಯಾಯಾಲಯ ಗಮನಿಸಿದೆ.

ಈ ಸಮಸ್ಯೆಯನ್ನು ಪರಿಹರಿಸಲು, ಭಾರತೀಯ ವಿಮಾ ನಿಯಂತ್ರಣ ಮತ್ತು ಅಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರ (IRDAI) ಅಗತ್ಯ ಮಾರ್ಗಸೂಚಿಗಳನ್ನು ಹೊರಡಿಸಿ ಹೊಸ ನಿಯಮಗಳನ್ನು ಜಾರಿಗೆ ತರಬೇಕೆಂದು ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ನಿರ್ದೇಶಿಸಿದೆ. ಇದರ ಉದ್ದೇಶ, ಹೆಚ್ಚು ವಾಹನಗಳು ದೀರ್ಘಾವಧಿಯವರೆಗೆ ವಿಮಾ ರಕ್ಷಣೆಯಲ್ಲಿರುವಂತೆ ಮಾಡಿ, ರಸ್ತೆ ಅಪಘಾತ ಸಂತ್ರಸ್ತರಿಗೆ ಸಮರ್ಪಕ ಪರಿಹಾರ ದೊರಕುವಂತೆ ಮಾಡುವುದಾಗಿದೆ.

ಇದರ ಜೊತೆಗೆ, ಮೋಟಾರು ವಿಮಾ ವ್ಯವಸ್ಥೆಯನ್ನು ಇನ್ನಷ್ಟು ಪಾರದರ್ಶಕ ಹಾಗೂ ಗ್ರಾಹಕ ಸ್ನೇಹಿಯಾಗಿಸಲು ನ್ಯಾಯಾಲಯ ಒತ್ತಾಯಿಸಿದೆ. ಕಡ್ಡಾಯ ವಿಮೆ ನಿಯಮಗಳ ಪರಿಣಾಮಕಾರಿ ಜಾರಿ, ವಿಮೆಯಿಲ್ಲದ ವಾಹನಗಳನ್ನು ಗುರುತಿಸಲು ತಂತ್ರಜ್ಞಾನ ಬಳಕೆ ಹಾಗೂ ಮಾನ್ಯ ತೃತೀಯ ಪಕ್ಷ ವಿಮೆ ಹೊಂದಿರುವ ವಾಹನಗಳಿಗೆ ಮಾತ್ರ ಇಂಧನ ಪೂರೈಕೆ ಮಾಡುವಂತಹ ಪೈಲಟ್ ಯೋಜನೆಗಳನ್ನೂ ಪರಿಶೀಲಿಸುವಂತೆ ಸೂಚಿಸಿದೆ.

ಈ ಆದೇಶವು ಹೊಸದಾಗಿ ಖರೀದಿಸುವ ವಾಹನಗಳಿಗೆ ಮಾತ್ರ ಅನ್ವಯಿಸುತ್ತದೆ ಹಾಗೂ ಕಡ್ಡಾಯ ತೃತೀಯ ಪಕ್ಷ ವಿಮೆಗೆ ಮಾತ್ರ ಸಂಬಂಧಿಸಿದೆ. ಇದು ಇತರರಿಗೆ ಉಂಟಾಗುವ ಗಾಯ, ಸಾವು ಅಥವಾ ಆಸ್ತಿ ಹಾನಿಗೆ ಸಂಬಂಧಿಸಿದ ಕಾನೂನುಬದ್ಧ ಹೊಣೆಗಾರಿಕೆಯನ್ನು ಮಾತ್ರ ಒಳಗೊಂಡಿರುತ್ತದೆ. ಸಮಗ್ರ (Comprehensive) ಮೋಟಾರು ವಿಮೆಯ Own Damage ಕವರ್‌ಗೆ ಈ ಆದೇಶವು ಸ್ವಯಂಚಾಲಿತವಾಗಿ ಅನ್ವಯಿಸುವುದಿಲ್ಲ; ಅದು ವಿಮಾ ಕಂಪನಿಗಳ ಪಾಲಿಸಿ ನಿಯಮಗಳ ಪ್ರಕಾರ ಮುಂದುವರಿಯುತ್ತದೆ.
